Iron Kraken Design LLC. – Terms of Service, Disclaimer & Limitations of Liability

Artwork, Pictures, Logos & Provided Content

Any artwork, logos, photographs, symbols, or design elements submitted by the customer—or requested by the customer for use by Iron Kraken Design.—may originate from sources not owned or controlled by Iron Kraken . It is solely the customer’s responsibility to ensure they have legal authorization to use any artwork included in their custom design.

Iron Kraken Design assumes no liability for copyright, trademark, or intellectual property disputes arising from customer-provided or customer-requested content.

By commissioning a design, the customer agrees to take 100% responsibility for any legal issues resulting from unauthorized use of protected material.

Die Molds & Production Files
All die molds, sculpt files, master tooling, and production assets created for custom coins, patches, or other physical products remain the exclusive property of Iron Kraken Design.

These materials may only be used for:

  • Customer reorders,
  • A reorder placed by a party formally authorized by the customer.

This policy protects the integrity, quantity control, and intellectual property of each design.

Die molds are retained for two (2) years from the date of the last production run.

If a reorder is requested after this period, a new mold fee will be required.

Cancellations / Returns
Because our products are custom-made, all sales are final and cannot be returned or refunded for any reason.

  • If the customer cancels after die mold production begins but before units are produced, the customer is responsible for a non-refundable fee equal to the quoted mold cost.
  • If cancellation occurs after the custom items have been manufactured, the customer is responsible for the full balance of the order.


Order Approval & Production

Production will not begin until:

  1. The customer provides written approval of the final artwork layout,
  2. All spelling, design elements, and PMS colors are verified, and
  3. A purchase order or full payment is received.

Iron Kraken Design is not responsible for errors overlooked by the customer during the approval process.

Shipping

Customers are responsible for all shipping costs.

Shipping prices may vary based on size, weight, quantity, and destination.

Estimated production and delivery timelines are typically 4–6 weeks, but Iron Kraken Design. makes no guaranteed delivery dates.

Iron Kraken Design is not liable for:

  • Delays caused by carriers, customs, weather, or force majeure
  • Loss of profit or revenue due to late delivery
  • Lost, delayed, or damaged shipments once transferred to the carrier

Misprints, Errors & Proof Samples

Iron Kraken Design makes an error in production, we will replace the affected items at no cost.

To process replacement:

  • A damage/error form must be submitted,
  • Photographs of the affected items must be provided.

Iron Kraken Design reserves the right to retain, display, or sell misprints, overruns, and sample items through retail or wholesale channels after 3–5 years.

Proof samples minted for quality assurance may be used for:

  • Display
  • Portfolio examples
  • Marketing
  • Future product samples

Customer Feedback & Testimonials

Any reviews, comments, or feedback sent via email, social media message, or postal mail may be used by Iron Kraken Design as testimonials on our website, social media, or marketing materials.


Submission of feedback constitutes authorization for use.


Copyright & Intellectual Property


All Iron Kraken Design logos, trademarks, designs, website content, and branding—including IronKrakenCo.com—are protected intellectual property. No portion of the website or brand assets may be copied, reproduced, or distributed without written permission.


Design Rights

When you hire Iron Kraken Design, you’re commissioning us to create a unique design—but the rights to the artwork remain with us unless a separate buyout agreement is signed.

This means:

  • Iron Kraken Design may reuse, resell, reproduce, or repurpose designs unless otherwise agreed in writing.
  • Customers may use the design for personal, non-commercial use only unless granted commercial rights.
  • Designs may not be sold, altered, reproduced, or used commercially without written authorization.

We may showcase your finished product or design on:

  • Our website
  • Social media
  • Marketing materials
  • Sample boards
  • Trade displays


By working with Iron Kraken Design, you acknowledge and accept these terms.
